Abstract: The objective of this thesis is studying a case study of child protection on children who are not cared for because their parents were detained or imprisoned. There are two problems that appear in this connection. Firstly, children of the detainees or the prisoners are often left without care. Secondly, the failure to protect the interests of the child is that government officials are limited in the scope to investigate in more detail the underlying family problems. Therefore, this thesis argues about effectiveness of current child protection laws on children who are not cared for because their parents were detained or imprisoned case in Thailand. The study has found that under the Child Protection Act B.E. 2546, there is only child’s welfare measure that could help children who are not cared for because their parents were detained or imprisoned. Moreover, the Civil and Commercial Code limits the scope of children protection just for revocation of parental authority who parents were imprisoned except parent who was detained. And the Criminal Procedure Code only specifies some of children who could be cared by mother is in prison also. It shows that Thai child protection laws are still unable to protect those vulnerable children. Moreover, government officials are lack of preventative measures to help children who parents are detained or imprisoned.
